Markwells Wood: New Breach of Condition Notice issued

The South Downs National Park Authority has issued a new breach of condition notice relating to Markwells Wood to UKOG (GB) Ltd. The notice, issued on 17 July 2018, relates to planning regulations only.

The breach of condition notice relates to planning permission SDNP/13/01347/CND as amended by SDNP/15/01470/CONDC which required that all operations on the site should be finished by end of September 2016. A further application for the site was received in September 2016 but withdrawn by the applicant before it could be determined. No further applications have since been submitted.

The new notice follows an earlier breach of condition notice issued on 14 March 2018 and withdrawn on 24 April 2018 following legal advice regarding a technical challenge by UKOG (GB) Ltd. The premise of the breach of conditions remains valid.

We consider that the applicant is now in breach of condition 2 of SDNP/15/01470/CONDC requiring that all buildings, plant and machinery, including foundations and hard standings should be removed and the site restored according to an approved scheme.

The applicant has six months from 17 July 2018 to remove all material from the site and 12 months from that date to implement the approved restoration scheme.
We will monitor the site carefully over the next 12 months and, if the applicant remains in breach of conditions, will consider taking further legal action.
