Bury Neighbourhood Plan
Bury Parish Council are preparing a Neighbourhood Development Plan (NDP) for Bury. Further details of the neighbourhood plan preparation are available at the Bury Parish Council website.

The Bury NDP (Submission Plan incorporating the Examiner’s modifications and all modifications as per the SDNPA Decision Statement) complies with the legal requirements and basic conditions set out in the Localism Act 2011 and as a result of the SDNPA Planning Committee resolution on 12 April 2018 has been made. Bury Neighbourhood Plan – Made Plan The Bury NDP is a part of the Development Plan of the SDNPA Local Planning Authority area as defined by the Neighbourhood Area Designation by the SDNPA on 12 December 2015. | Referendum |
The Bury NDP has been modified in accordance with the Decision Statement. On Thursday 1 March 2018 there will be a Referendum on a neighbourhood development plan in the Bury parish area. | Decision on a Plan – Final Decision Statement |
The period for submitting representations on the proposed decision statement for the Bury NDP has now closed. No objections were received to the proposed minor variations to the Examiners Recommendations. The representation from Historic England supported the retention of the designation of the Wharf and Common Land as a Parish Heritage Asset – BNDP Policy 8. The Final Decision Statement is therefore published. This sets out the modifications that will be made to the plan in response to the Examiners recommendations. The Bury NDP will be modified accordingly and will proceed to referendum on the 1st March 2018. |
| Proposed Decision Statement |
On 17th November 2017, the SDNPA agreed the Proposed Decision Statement for the Bury NDP. The Decision Statement accepts all the modifications set out in the Examiner’s report apart from two minor variations from the Examiner’s recommendations. These are:
Under the Neighbourhood Planning (General) regulations 2012 (as amended), if the Local Planning Authority proposes to make a decision which differs from that recommended by the Examiner, it must notify the: qualifying body, consultation bodies and those that made representations to the Examiner; of their proposed decision (and the reason for it) and invite representations on the variations. The closing date for representation is Friday 12th January 2018. |
| Independent Examination | The SDNPA appointed John Slater MRTPI as independent Examiner of the Bury NDP. The Examiner has now issued his final report, which the SDNPA will consider. A ‘Decision Statement’ will be prepared shortly setting out the actions to be taken in response to the recommendations of the Examiner.
Documents Produced during the Bury Neighbourhood Plan Examination During the Examination of the Bury Neighbourhood Development Plan, the Independent Examiner (Mr John Slater) has requested further information to enable him to carry out the Examination. His email in respect to this is set out below and relates to further information to support the designation of a number of parish heritage assets. | Publicising the Plan proposal |
The SDNPA has published the submitted Bury NDP for consultation in accordance with Part 5 of the Neighbourhood Planning (General) Regulations 2012. The consultation will run from Wednesday 12 July to Wednesday 23 August 2017. Representations made on the Bury NDP will be considered by an independent examiner who will assess whether the NDP meets certain legal requirements, known as the ‘basic conditions’.
